general
- Terms of Reference:
- “we” “our” “us” refers to Solumac Limited and all its employees and contracted workers.
- “you” “your” refers to any user/visitor of Solumac Limited Web Site.
- You may not assign, sub-license or otherwise transfer any of your rights under these terms and conditions.
If any provision of these terms and conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these terms and conditions, which shall remain in full force and effect.
- If you breach these terms and conditions and we ignore this, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach these terms and conditions.
- SOLUMAC LTD shall not be responsible for any breach of these terms and conditions caused by circumstances beyond its control.
- Any person who is not a party to these terms and conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any of these terms and conditions but this shall not affect any right or remedy of a third party which exists or is available apart from that Act.

access and use
- All material available on the SOLUMAC LTD Site (including content available on our email and SMS services) (the "Content") belongs to SOLUMAC LTD or its licensors. SOLUMAC LTD or its licensors own all intellectual property rights (including copyright and database rights) in the Content and any selection or arrangement of the Content. You may retrieve and display Content on a computer screen, PDA or mobile telephone, print individual pages on paper (but not photocopy them) and store such pages in electronic form on disk or on your mobile telephone (but not on any server or other storage device connected to a network) for your personal, non-commercial use.
- You may not use the SOLUMAC LTD Site for any unlawful purpose. Except as expressly set out above, you may not reproduce, publish, broadcast, transmit, modify, adapt, create derivative works of, store, archive or in any way commercially exploit any of the Content.

- You will be responsible for all losses, liabilities, costs and expenses reasonably suffered or incurred by us, all damages awarded against us under any judgment by a court of competent jurisdiction and all settlement sums paid by us as a result of any settlement agreed by us arising out or in connection with:
- Any claim by a third party that the use of the SOLUMAC LTD Site by you is defamatory, offensive or abusive, or of an obscene or pornographic nature, or is illegal or constitutes a breach of any applicable law, regulation or code of practice.
- Any claim by any third party that the use of the SOLUMAC LTD Site by you infringes that third party’s copyright or other intellectual property rights of whatever nature; and
- Any fines or penalties imposed by any regulatory, advertising or trading body or authority in connection with the use of the SOLUMAC LTD Site by you.
- You acknowledge that "SOLUMAC LTD" and the other SOLUMAC LTD sub-brands are registered and unregistered trade marks and that you may not use them without written permission from SOLUMAC LTD.

- If you provide SOLUMAC LTD with an email address that will result in any emails or SMS messages sent you by SOLUMAC LTD being sent to you via a computer network or telephone operated or owned by a third party (e.g. your employer or college) then you warrant that you are entitled to receive those messages. You also agree that SOLUMAC LTD may refrain from sending messages to you without notifying you, even if you have subscribed to receive them, if we receive a request from a third party to stop sending emails or SMS messages to you.
technical requirements and site security
- The SOLUMAC LTD Site is best viewed using the Internet browsers IE5 and above or Netscape 6 (or later versions). Any older browser versions may work but users could have limited browsing experience.
SOLUMAC LTD liability
- The SOLUMAC LTD Site is provided by SOLUMAC LTD without any warranties or guarantees. You must bear the risks associated with the use of the Internet.
- SOLUMAC LTD shall develop and operate the SOLUMAC LTD Site with reasonable skill and care and has reasonable security procedures in place.
- In particular SOLUMAC LTD shall not be liable to you for:
- Incompatibility of the SOLUMAC LTD Site with any of your equipment, software or telecommunications links.
- Technical problems including errors or interruptions of the SOLUMAC LTD Site.
- Unsuitability, unreliability or inaccuracy of the SOLUMAC LTD Site; or
- Inadequacy of the SOLUMAC LTD Site to meet your requirements.
- To the full extent allowed by applicable law, you agree that SOLUMAC LTD will not be liable to you for any losses which are not a direct consequence of your use of the SOLUMAC LTD Site (including loss of profits or loss of privacy or loss of or damage to data) or which arise as a result of your using the SOLUMAC LTD Site outside the scope of these Terms and conditions.
- Nothing in these Terms and conditions shall exclude SOLUMAC LTD’s liability for personal injury or death caused by its negligence or fraud.
third party sites and services
- The SOLUMAC LTD Site contains links to other Internet websites or online and mobile services provided by independent third parties ("Third Party Sites"), either directly or through frames. Third Party Sites may be co-branded with SOLUMAC LTD and so include SOLUMAC LTD's trade mark. SOLUMAC LTD is not responsible for the availability or content of Third Party Sites and will not be a party to, or in any way responsible for, any transaction concerning goods or services available from such Third Party Sites. If you purchase products or services from a Third Party Site, your contract for such products or services will be with the third party and not with SOLUMAC LTD. Our Privacy policy does not apply to Third Party Sites.
choice of law and jurisdiction
- These terms and conditions shall be governed by, and construed in accordance with, English law.
To the extent possible in the applicable jurisdiction, the parties irrevocably agree that the courts of England shall (subject to the paragraph below) have exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these terms and conditions, and for those purposes irrevocably submit all disputes to the jurisdiction of the English courts.
